On June 11, 2008, Plaintiff United States filed an Unopposed Motion 206 requesting that the hearing set for June 19, 2008, be continued five days to June 24, 2008, due to the schedule of counsel. All counsel agreed to the continuance of the hearing and on June 12, 2008, the Court entered an Order 207 granting the continuance to June 24th. On June 18, 2008, however, Defendants Rizzolo and The Power Company, Inc. filed a Reply Memorandum 211 which states the position that because of action taken by the Las Vegas City Council yesterday, it is imperative that the Court grant certain relief requested by Defendants immediately and without a hearing. Counsel for Defendants Rizzolo and The Power Company also offer unfounded speculation regarding the recent scheduling history of this case. Indeed, the Court has warned counsel for all interested parties at virtually every hearing conducted in this case that it is their collective responsibility to address the numerous issues raised before the value of the property at issue diminishes substantially. Regardless, given the timing issues noted in Defendants' Reply Memorandum filed yesterday 211 , the Court deems it necessary to advance by one day the hearing previously scheduled for June 24, 2008, to Monday, June 23, 2008, at 2:30 P.M.
